Terms and booking process

These terms form the basis upon which you (the customer) and us (the company) Gypsy Adventure Travel Pty Ltd may use and conduct business through campervanrentalshop.com.au or any related websites.
Our website lists a “from” price for the vehicle. Campervan companies change their rates all the time as we are a 3rd party website we negotiate the best rate at the time on behalf of you (the customer).

The deposit we take guarantees the booking and is a part payment of the total price of the vehicle you have selected.
The payment is required by the operators of this site to book a customer’s vehicle. A deposit that is received and retained by Gypsy Adventure Travel Pty Ltd. The deposit we take guarantees the booking and is a part payment of the total price of the vehicle you have selected. The remainder of the cost is paid to the rental supplier on pick up.
Deposit prices are chosen at the sole discretion of Gypsy Adventure Travel Pty Ltd and are subject to the refund policies outlined in this document.

The quote that is sent to the customer has a full break down of cost and what is included.

Refunds

If the vehicle you book has sold out in between the time of paying the deposit Gypsy adventure travel will issue a full refund on deposit and of one of our sales team will call you to discuss other vehicle options.

When you arrive at the depot you must pick up the vehicle that is offered or you risk a 100% cancellation fee. If the vehicle is different to the vehicle you have booked please call your sales rep to discuss other alternatives.

No refund of your deposit

If a miscommunication takes place between the customer and the agent Gypsy adventure travel can be liable for a refund or part refund of the deposit. The agents make notes on all phone call communications and emails are saved which we will refer to as needed for the purposes of resolving any disputes.

In the event that you wish to change your travel plans or change your vehicle, there will be no refund or partial refund of your deposit. Changes of this nature should be requested through your agent. If you wish to cancel, Cancellation Fees will be applied (see below).

Credit Card Dispute Fees

All payments through our websites will appear on your statement as “Gypsy Adventure Travel” or “campervanrentalshop.com.au” depending on what currency you use. Requests for refunds on your deposit must be go through the agent you have been dealing with, they should never be directed to your credit card issuer. Gypsy Adventure Travel will ensure that attempts to reclaim money through credit card issuers fail. We store the following in your “case history” and provide it to our credit card merchant operators to ensure that refunds of this type are rejecter:

  • Very detailed notes from all phone calls
  • Instant messenger chats
  • Email text
  • A video recording of the online session whereupon you paid the deposit and accepted these Payment Terms
  • Every link that you have clicked on and the time of that click
  • Your name, phone number, country you live in and all IP addresses used to access the site

To date we have been successful in 100% of credit card disputes. However there is significant time spent compiling the above information. Gypsy Adventure Travel Pty Ltd will apply a fee of AUD$150 for Australian pickups and NZD$150 for NZ pickups for all chargeback requests as a once off fee. If a dispute is found to be in your favour because there is evidence of fraudulent purchases on your credit card (note though that your IP address and therefore your location and also your phone number etc is stored, so legitimate cases of fraud have not yet been found) the Credit Card Dispute Fee will be waived.

Cancellations and modifications requests must be directed to your agent. Cancellations within 30 days from pickup are subject to Cancellation Fees as outlined below.

Cancellation Fees

The deposit for the reservation is never refundable if you cancel the booking, the following additional fees will also apply:

  • if cancelled 0 to 7 days from pickup: 100% of total hire. Minimum fee payable is $250.
  • if cancelled 7 to 21 days from pickup: 50% of total hire. Minimum fee payable is $250.
  • if cancelled less than 22 – 90 days from pickup: 30% of total hire. Minimum fee payable is $250.
  • if cancelled on the same day of pickup or a “no show” on day of pickup: 100% of total hire. Minimum fee payable is $400.

We strongly recommend that renters ensure they take out the highest level of Travel Insurance.

Cancellations processed through the Rental Company are also subject to the above Cancellation Fees. Cancellation Fees will be applied upon notification from the customer or the Rental Company. A failure to pickup your vehicle is considered a “no show” and is therefore subject to the fee outlined above.

These Terms apply in full force and effect to your use of this Website and by using this Website, you expressly accept all terms and conditions contained herein in full. You must not use this Website, if you have any objection to any of these Website Standard Terms And Conditions.

This Website is not for use by any minors (defined as those who are not at least 18 years of age), and you must not use this Website if you a minor.

Other than content you own, which you may have opted to include on this Website, under these Terms, Gypsy Adventure Travel Pty Ltd and/or its licensors own all rights to the intellectual property and material contained in this Website, and all such rights are reserved.

You are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Website,

You are expressly and emphatically restricted from all of the following:

  1. publishing any Website material in any media;
  2. selling, sublicensing and/or otherwise commercializing any Website material;
  3. publicly performing and/or showing any Website material;
  4. using this Website in any way that is, or may be, damaging to this Website;
  5. using this Website in any way that impacts user access to this Website;
  6. using this Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Website, or to any person or business entity;
  7. engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website, or while using this Website;
  8. using this Website to engage in any advertising or marketing;

Certain areas of this Website are restricted from access by you and Gypsy Adventure Travel Pty Ltd may further restrict access by you to any areas of this Website, at any time, in its sole and absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality of such information.

4. Your Content.

In these Website Standard Terms And Conditions, “Your Content” shall mean any audio, video, text, images or other material you choose to display on this Website. With respect to Your Content, by displaying it, you grant Gypsy Adventure Travel Pty Ltd a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be infringing on any third party’s rights. Gypsy Adventure Travel Pty Ltd reserves the right to remove any of Your Content from this Website at any time, and for any reason, without notice.

5. No warranties.

This Website is provided “as is,” with all faults, and Gypsy Adventure Travel Pty Ltd makes no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on this Website shall be construed as providing consult or advice to you.

6. Limitation of liability.

In no event shall Gypsy Adventure Travel Pty Ltd nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and Gypsy Adventure Travel Pty Ltd including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

7. Indemnification.

You hereby indemnify to the fullest extent Gypsy Adventure Travel Pty Ltd from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

8. Severability.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

9. Variation of Terms.

Gypsy Adventure Travel Pty Ltd is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Website.

10. Assignment.

[Gypsy Adventure Travel Pty Ltd shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, .you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

11. Entire Agreement.

These Terms, including any legal notices and disclaimers contained on this Website, constitute the entire agreement between Gypsy Adventure Travel Pty Ltd and you in relation to your use of this Website, and supersede all prior agreements and understandings with respect to the same.

12. Governing Law & Jurisdiction.

These Terms will be governed by and construed in accordance with the laws of the State of NSW and you submit to the non-exclusive jurisdiction of the state and federal courts located in NSWfor the resolution of any disputes.
